From what I understand, The Experiment is not an actual Heartless and nothing official states it as so. You could argue that "Well Dr. Finkelstien INTENDED to create a Heartless, and the Battle Hint says "Defeat Dr. Finkelstien's experimental Heartless !", so it has to be a Heartless." I would say that it isn't a Heartless because one a Heart does not release after Sora defeats it and all Artificial Heartless release Hearts, he may have INTENDED to create a Heartless but made something else.
